Additionally, if your employment tax deposits are paid on time and in full for the quarter, you will have an extra 10 business days to file from the due date. Employers must file Form 941 every quarter, even if they have no taxes to report, unless they fall into one of the exceptions above. The due dates typically fall on the last day of the month following the end of the quarter, giving employers one month to prepare the form. If any due date for filing falls on a Saturday, Sunday, or legal holiday, returns may be filed on the next business day. Calculating and reporting the taxes – You become liable for employment taxes when you pay the employees their wages, not when the pay period ends.

Form 944 is designed for employers with an annual employment tax liability of $1,000 or less. However, if you made timely deposits in full payment of your taxes for the year, you may file by February 10. As with Form 941, if the due date for filing a return falls on a Saturday, Sunday, or legal holiday, you may file the return on the next business day. The purpose of Form 944 is to reduce burden on small employers by allowing them to file one return per year and in most cases pay the employment tax with the return. Similarly, if you’re required to file Form 944 and your employment tax liability for the year is less than $2,500, you may pay the taxes for the year with your timely filed return instead of making deposits. Employers below the $2,500 threshold who aren’t required to make deposits may choose to deposit the taxes or pay the amount shown as due on the Form 941 or Form 944 when they file that form, as provided by the form instructions.

Form 941: Employer’s Quarterly Federal Tax Return

IRS Form 941 — more commonly known as the Employer’s Quarterly Federal Tax Return — is the form your business uses to report income taxes and payroll taxes withheld from your employees’ wages. It also provides space to calculate and report Social Security and Medicare taxes. In general, employers who withhold federal income tax, social security or Medicare taxes must file Form 941, Employer’s Quarterly Federal Tax Return, each quarter. This includes withholding on sick pay and supplemental unemployment benefits. At the top of the form, write in your employer identification number (EIN), name, and business address. Not all types of businesses need to file Form 941, including some seasonal businesses, companies that employ farmworkers, and individuals employing household staff, such as maids (but they may need to file Form 1040 instead). The deadlines for filing Form 941 are strict, and fall on the last day of the month following the end of a quarter (April 30, July 31, Oct. 31, and Jan. 31). Employers notified to file Form 944, whose businesses grow during the year and whose employment tax liability exceeds the $1,000 threshold, must still file Form 944 for the year. Employers who exceed the eligibility threshold must not file Form 941 until the IRS notifies them that their filing requirement has been changed to Form 941. If this happens, you become a semiweekly depositor for at least the remainder of the calendar year and for the following calendar year.

What Is Tax Form 941, and Who Needs to File It?

If you permanently go out of business or stop paying wages to your employees, you must file a final return and make the appropriate indication on the 941 form. Not filing IRS Form 941 by the due date or reporting less tax liability than what you actually owe can lead to stiff IRS penalties. The IRS charges a penalty of 5% of the total tax amount due, and you can be charged an additional 5% fee every month your return has not been submitted, for up to five months. Most businesses are required to file Form 941 quarterly, with a few exceptions.

Note that being unaware of your tax obligations is not considered reasonable cause. Before the beginning of each calendar year, you must determine which of the two deposit schedules you are required to use. To determine your payment schedule, review Publication 15 for Forms 941, 944 and 945. In Part Four, the employer is asked whether they will authorize an employee, paid tax preparer, or another third party such as a Certified Public Accountant (CPA) to speak with the IRS regarding the return. If the answer is yes, the employer must provide the designee’s name, phone number, and a self-selected five-digit personal identification number so the IRS can confirm the person’s identity. The mailing address will depend on a few factors, including the state your business operates in, which quarter you are filing for, and whether payment has been included in your return.
